PRIVACY POLICY

Vibrant Energy and/or its affiliates and/or its group entities (together referred to as the “Company”) recognizes the expectations of its customers, employees, users of website and any person sharing Personal Data/ or Information or confidential information with us, (the “User(s)”) with regard to privacy, confidentiality and security of such Personal Data or Information that is retained by the Company. Keeping the Personal Data or Information of such Users secure and using it solely for authorised purposes and preventing any misuse thereof is a top priority of the Company. The Company has adopted this organisation wide privacy policy aimed at protecting the Personal Data or Information entrusted and disclosed by such User (the “ Policy”). This Policy governs the way in which the Company collects, uses, discloses, stores, secures and disposes off Personal Data or Information and Sensitive Personal Data or Information.

For the purposes of this Policy, wherever the context so requires “you” or “your” shall mean the User(s) and the term "we", "us", "our" shall mean Company.

DEFINITIONS

"Personal Data or Information" means any information that relates to a natural person, which either directly or indirectly, in combination with other information available or likely to be available with the Company, is capable of identifying such person.

"Sensitive Personal Data or Information" of a person means such Personal Data or Information which consists of information relating to such person's:

  • financial information such as Bank account or credit card or debit card or other payment instrument details;
  • physical, physiological and mental health condition;
  • sexual orientation;
  • medical records & history;
  • biometric information;
  • any detail relating to the information referred above as provided to a body corporate for providing service/(s);
  • any of the information referred above, receivedd by a body corporate for processing, is stored or processed under lawful contract or otherwise.

  • Provided that, any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as Sensitive Personal Data or Information for the purposes of this Policy.

APPLICABILITY

This Policy is applicable to Personal Data or Information and Sensitive Personal Data or Information collected by the Company and/or its affiliates directly from any of the User/(s) or through the Company’s online portals (including websites, social media handles or profiles), mobile apps and electronic communications or biometric scanner, as also any information collected by the Company’s server from the User’s browser.

USER CONSENT AND TYPE OF INFORMATION COLLECTED

The Company only collects data or information (including any Personal Data or Information) after obtaining consent, which can be explicit, e.g., through a consent form signed at time of seeking employment or executing any contract in relation to a business relationship, or implicit e.g., using or accessing our website, apps, social media pages. Company collects Personal Data or Information from any User/(s) only if it has been provided voluntarily. The type of personally identifiable information that may be collected by us includes and is not limited to, name, address, e-mail address, in case of User or visitor of our website and it may include records or data relating to educational and professional background, government IDs, medical check-up, biometric data in case of employees or people seeking employment with Company or its affiliates, and information about your interests in and use of various services.

The information provided by the User is not given or sold to any private organization(s) or private persons, without explicit consent of the User. Company may collect additional information at other times, including but not limited to, when Users provide feedback, comments, change their content or email preferences, respond to a survey, or any communications with the Company

PURPOSE OF COLLECTION AND USE OF PERSONAL DATA OR INFORMATION

The Company collects and uses the financial information and other Personal Data or Information from Users of its website and any User sharing data for specific purpose, viz., to be used for specific business purposes or to reach out to customers; to improve its products and services; or for customary record keeping in case of its employees. Company may use such information for related purposes or for a lawful purpose to comply with the applicable laws and regulations. We may, however, use your email address for non-marketing or administrative purposes (such as notifying you of major changes, for customer service purposes, billing, etc.).

The authenticity of the Personal Data or Information provided by any User shall not be the responsibility of the Company.

COLLECTION OF INFORMATION BY THIRD-PARTY SITES

Company’s website(s) and social media profiles sometimes may contain links to other websites whose privacy policies may be different to ours. Visitors/Users should consult such other sites’ privacy notices/policies separately, as the Company has no control over information that is submitted to, or collected by these third parties.

INFORMATION COLLECTED AND STORED AUTOMATICALLY

If you visit the Company’s website(s) just to browse, read pages or download information, but do not register, we gather and store certain information about your visit automatically. This information cannot and does not identify you personally. The kind of information that is gathered automatically include the type of browser you are using (e.g., Netscape, Internet Explorer, Chrome, Microsoft Edge), the type of Operating System you are using (e.g., Windows or Mac OS), the domain name of your Internet Service Provider (e.g., America Online, Satyam Online, Mantra Online, VSNL), the date and time of your visit and the pages you visit, along with geographical information such as the Country, Region or City, etc. We sometimes use this non-personally identifiable information to improve our website(s), their design, content to primarily give you a better browsing experience. DATA ERASURE

Company shall retain Personal Date or Information as long as necessary for it to carry out the specific purpose for which the Personal Data or Information has been collected, or till the User concerned asks to not retain their data or information. However, in case of employees of the Company or its affiliates, such data shall be retained in a secured way even after cessation of employment. If you no longer want the Company to use your information then you can request that we erase your Personal Data or Information and close the login account (if any) as soon as reasonably possible, based on your account activity and in accordance with applicable law(s). You can request for deletion of your information by writing to our designated Grievance Officer (refer below), via in writing or through email signed with the electronic signature.

INFORMATION SHARING

The Company shares your Personal Data or Information with any third party without obtaining the prior consent in the following limited circumstances:

  1. When it is requested or required by law or by any court or governmental agency or authority to disclose, for the purpose of verification of identity, or for the prevention, detection, investigation including but not limited to cyber incidents, or for prosecution and punishment of offences. These disclosures are made in good faith and belief that such disclosure is reasonably necessary for enforcing these terms or for complying with the applicable laws and regulations.
  2. The Company proposes to share such Personal Data or Information to conduct its business and to share such Personal Data or Information within its group companies and officers and employees of such group companies for the purpose of processing Personal Data or Information on its behalf. We also ensure that these recipients of such Personal Data or Information agree to process such information based on our instructions and in compliance with the terms of this Policy and any other appropriate confidentiality and security measures.
  3. The Company may share information regarding your activities on the website or social media (of the Company) with third parties for analysing or categorising traffic.
  4. We may share your Personal Data or Information to enforce or protect our rights or any or all of its affiliates, associates, employees, directors or officers or when we have reason to believe that disclosing such Personal Data or Information is necessary to identify, contact or bring legal action against someone who may be causing interference with our rights or our website or online presence or brand, whether intentionally or otherwise, or when anyone else could be harmed by such activities.

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where we store Personal Data or Information. All information gathered on the Company’s websites is securely stored within the Company controlled database. Any data or information or prospective employees or employees is secured with limited access available with identified individuals or human resources department of Company. The database is stored on servers secured behind a firewall; access to the servers is password-protected and is strictly limited. However, as effective as our security measures are, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that the information you supply will not be intercepted while being transmitted to us over the Internet. And, of course, any information you include in a posting to the discussion areas is available to anyone with Internet access.

UPDATES/ CHANGES

The internet is an ever-evolving medium. We may alter our Policy from time to time to incorporate necessary changes in technology, applicable law or any other variant. In any case, we reserve the right to change (at any point of time) the terms of this Policy. . Any changes we make will be effective immediately on notice, which we may give by posting the new policy on the website. Your use of the website or apps or other equipments such a Biometric scanner after such notice will be deemed acceptance of such changes. We may also make reasonable efforts to inform you via electronic mail. In any case, you are advised to review this Policy periodically on the sites to ensure that you are aware of the latest version.

We request you to please provide the following information in your complaint:

  1. Full name along with postal residential address, email id and cell number.
  2. Self-attested photocopy or scanned copy of Government issued photo-identity.
  3. Title & date/ link of news report, article or content which is the subject matter of the complaint to set out the sentence(s) or word(s) verbatim from news report, article, editorial or content in respect of which there is a grievance or explanation in 500 words.
  4. Clear statement to identify whether the data or information is personal or sensitive personal information.
  5. Specify what supporting documents if any are relied upon and attached clear readable scanned copies thereof. If you rely on a court order, please ensure the scan is of a certified copy. The Court, case number and the Judge passing the order should be clearly visible.
  6. A signed declaration that whatever information and/or documents are submitted with the complaint are true, complete and current in all respects and nothing therein is false.
  7. A statement, under penalty of perjury, that the information in the notice is accurate, and that the information being complained about belongs to you.
